Executors

An Executor is someone you appoint in your Will to see that your wishes and instructions are carried out. It is wise to appoint at least two Executors, particularly if young children may benefit under your Will. You should note that a husband and wife can appoint each other.

Guardians for Your Children

If you have children under 18 you may wish to appoint one or two persons to be their Legal Guardians. You should ensure that you have discussed your intended wishes with the person you wish to appoint as guardian as legal guardianship does involve a lot of responsibility.

Residue

The residue is everything left in your Estate after debts, funeral expenses and any legacies have been paid. In a standard family Will, the residue will be left to your spouse/partner, but should that spouse/partner die before you, the residue will then pass to your children (if any) and grandchildren (if any)

Standard Family Residue Provisions:

Leave everything to spouse/partner

If my spouse/partner does not survive me then the residue should go to my children

If any child of mine were to die before me then their share should go to their children

or Named Beneficiaries

I leave everything to the following persons:

Reserve/Longstop Beneficiaries

In case all of your previous beneficiaries fail to survive you, it is sensible to name reserve beneficiaries. People named in this section will only benefit from your residuary estate if all previously named beneficiaries die before you.
